Yes, false advertising is illegal in the United States. Federal law, enforced by the Federal Trade Commission (FTC), and various state consumer protection laws prohibit deceptive marketing. Advertisements must be truthful, not misleading, and supported by evidence.Â

Key Aspects of False Advertising Laws
Definition:Â Advertising is considered false or deceptive if it misrepresents a product's quality, ingredients, or effectiveness
. This includes misleading pricing, such as "phantom discounts" and "bait and switch" tactics, where a product is advertised with no intention to sell it.
Legal Protections: Under Section 43(a) of the Lanham Act, businesses can be sued for false advertising. Consumers can also file lawsuits under state-specific laws, such as California Business and Professions Code Sections 17500 and 17200.
Consequences: Penalties can include costly lawsuits, class action damages (e.g., the $45 million Dannon settlement), and orders to stop the advertising.
