WOW - item has been used!

No where in the description did it say that this item (Clinique Lip Pencil) was used. And upon opening the package, it was clear this one was. No protective seal, which Clinique and other manufactures place on lip pencils. And the lip pencil is extended out! I'm not even sure how much has been used. What a waste of money!
