Leaking from shower head when filling the tub

Who may I contact on this new install. Contacted the plumber, no response so decided to reach out to the experts. If I can get this fixed I'll move this to a 5 star since this is the only issue I have. Problem: When filling the tub and the diverter is in the down position water still drips from the shower head. When I pull the diverter in he up position the shower works great. Need to stop the shower drip when filling the tub. Help.

Most likely, you are experiencing "shower-rise," where the water can’t get out of the spout as fast as it flows through the valve. This causes the water to back up and come out of the shower head. Looks great but only works for 6 months.

Looks great, works well for the first 6 months, then after it's a pain to get the water to divert and when it does, makes a squealing sound. I'm on my second one already and it's the same problems

Does not hold up

Bought a home that had this in our tub. Looked new but less than a year and the o-ring popped out of the top, and last weekend a rubber gasket fell out of the tub spout and no longer works. Not worth saving so we tossed it and got something else. Started to buy another tub spout (RP77092SS) as there is always a lemon but wasn't willing to risk over $100 to find out. Something that is really important to note is that the threaded connection on the back of this is ~1-1/8" which works with the adapter that Delta sells. You will not find a replacement for that size at Lowe's or Home Depot. Delta has them but you have to know what you're looking for and it irritates me that the adapter was soldered onto my copper line and unfortunately stuck with another Delta. I'm sure there are other manufacturer's that have 1-1/8" threaded connection but I don't have the time to research. If my new tub spout fails too then the adapter is getting tossed and I install a new copper line and install something else.
