Shipped to me damaged

This was shipped by a third-party seller. Packaging for the item was torn - outside shipping box was fine, so it was sent to me damaged. Walmart said I had to contact the third-party seller, all they did was offer for me to send back, no offer to re-deliver one in good condition. Very disappointed as this was to be a Christmas gift for my Grandson. Be careful shopping on Walmart on line as the product is not coming directly from Walmart.
