Warranty information
NICOR represents that it has manufactured or supplied certain components and assembled the product described (the “Product”) on its invoices. NICOR warrants that the components it manufactured or supplied, and its assembly of the Product(s) are free from defects in material and workmanship, when the Product is installed and used normally and in accordance with the Product’s operation instructions. This limited warranty extends only to Consumers of the Products that are purchased in the United States of America.
The limited warranty period for the Product extends for ONE (1) YEAR from the date of purchase.
This limited warranty does not cover:
Product that has been subjected to misuse, accident, shipping or other physical damage, improper installation, abnormal operation or handling, neglect, inundation, fire, water or other liquid intrusion; or
Product that has been damaged due to repair, alteration or modification; or
Product defects to the extent that the problem experienced results from or is caused by components incorporated in the Product that were not manufactured or supplied by NICOR; or
Product defects to the extent that the problem is caused by use with non-NICOR electrical accessories; or
Product purchased or used outside the United States; or
Product returned without valid proof of purchase.
EXCEPT TO THE EXTENT OF THE REPRESENTATION AND WARRANTY MADE ABOVE, (a) NICOR MAKES NO OTHER REPRESENTATIONS OR WARRANTIES, EXPRESS OR IMPLIED. BY WAY OF EXAMPLE BUT NOT OF LIMITATION, NICOR MAKES NO REPRESENTATIONS OR WARRANTIES OF MERCHANTABILITY OR FITNESS FOR ANY PARTICULAR PURPOSE.NICOR SHALL IN NO EVENT BE LIABLE TO THE PURCHASER, ITS SUCCESSORS, OR A THIRD PARTY,FOR ANY DAMAGES, WHETHER DIRECT OR INDIRECT, SPECIAL OR GENERAL, CONSEQUENTIAL OR INCIDENTAL, ARISING FROM ANY LOSS CLAIMED AS A RESULT OF THE USE OF THE PRODUCT; AND (b) NICOR MAKES NO WARRANTY OR REPRESENTATION THAT THE PRODUCT CAN BE USED FOR ANY PARTICULAR FUNCTION, AND NICOR ASSUMES NO RESPONSIBILITY FOR THE SAFETY, QUALITY, DESIGN, SPECIFICATIONS, COMPLETENESS, ACCURACY,OR OTHER CHARACTERISTICS OF THE PRODUCT.
If the Product is manufactured and/or assembled in accordance with plans, designs, and/or specifications supplied to NICOR by the Purchaser, NICOR’s limited warranty shall not be construed as conferring the indemnification by NICOR against any claim of infringement of intellectual property rights. Rather, the Purchaser warrants to NICOR that the Product does not infringe any patents, copyrights, trademarks, trade secrets, or other intellectual property rights of any other entity, and will indemnify and defend NICOR from any claim, liability and expense, including reasonable attorney fees and final judgment arising out of any breach of the foregoing warranty.
