Warranty Period. The Warranty Period begins on the date of retail purchase by the original purchaser of the Product, and continues for the specific period set forth below (“Warranty Period”). To view the exact warranty period of a specific Product, refer to the Product’s detail page or reach out to our Customer Success team. Warranty Claim. A claim under this Limited Warranty (“Warranty Claim”) is considered valid when filed by the original purchaser within the Warranty Period according to the instruction manual or Sunco's website, and must be received and approved by Sunco at its own discretion. The following conditions apply for a valid Warranty Claim: The Product must have been purchased directly from Sunco or a Sunco-authorized distributor/retailer. An original order number or original purchase receipt for the Product should be available for Sunco’s inspection. Adequate records of the Product's operating history must be maintained and made available for Sunco's inspection. Sunco reserves the right to accept or reject the validity of these records at its sole discretion. If necessary, a Sunco representative, or other authorized representatives, may inspect the Product to determine the cause of failure. Scope of Warranty. Under this Limited Warranty and to the maximum extent permitted by law, if (i) a Defect arises, and (ii) Sunco approves a valid Warranty Claim, Sunco reserves the right to replace the defective Product with either the same model or a suitable alternative at its sole discretion. A suitable alternative may be a similar product, or the same version or an available version of the same product, including any applicable revisions or upgrades, all at Sunco's sole discretion. In addition, Sunco may require the customer to undertake any of the following additional actions prior to offering any replacement: Covering shipping or restocking fees for replacement related to the Warranty Claim. Returning the defective Product subject to the Warranty Claim as instructed by Sunco, bearing all related shipping costs. Providing additional information to assist in assessing the Warranty Claim, including details about the Product's condition, usage, installation method, and possibly images or videos of the Product. Any product revisions or enhancements shall result in updated versions being provided for all replacements. Sunco does not cover the cost of shipping for replacements outside of the Continental United States. Furthermore, the costs associated with the installation or removal of any products, including materials and labor, fall outside the scope of this Limited Warranty and are not covered by Sunco. Exclusions and Limitations. This Limited Warranty is only applicable for Product manufactured by or for Sunco, identifiable by the Sunco trademark, trade name, or logo. This Limited Warranty is valid only for Products purchased within United States. The Limited Warranty excludes (i) any products and services by Sunco that are not the Product, (ii) non-Sunco hardware, (iii) consumables (for example, batteries), and (iv) software, regardless of whether items (i) –(iv) are packaged or sold with the Product or embedded in it. Sunco does not guarantee that the Product’s operation will meet Customer’s specific needs or requirements, or that it will be uninterrupted and error-free. Sunco shall not be liable for damages resulting from not following the Product's usage instructions or from failures caused by inadequate electrical supply or internet access. The Limited Warranty is void for Products or parts thereof that have been altered or modified by anyone other than a Sunco representative. Violation of any provisions in Sunco Terms and Conditions, Privacy Policy, or other agreements between Sunco and the customer, also voids this Limited Warranty. This Limited Warranty does not cover Defects or damages arising from (a) use with non-Sunco products; (b) external causes such as accidents, abuse, misuse, neglect, natural disasters; (c) using the product outside its intended uses or conditions as specified by Sunco, or with improper voltage or power supply; (d) services such as upgrades and expansions performed by non-Sunco representatives; or (e) Sunco products, parts, advice, assistance, or services given as a courtesy by Sunco. Additionally, this Limited Warranty is not applicable to Products used in violation of industry standards, codes, or instructions for use, such as those specified by Underwriters Laboratory, Inc. (UL), the American Standards Institute (ANSI), or the CSA Group (CSA). Exclusive Warranty. TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE WARRANTIES STATED ABOVE ARE EXCLUSIVE AND IN LIEU OF ALL OTHER WARRANTIES AND CONDITIONS, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WITHOUT LIMITATION THE IMPLIED WARRANTIES OF MERCHANTABILITY, NON-INFRINGEMENT, FITNESS FOR A PARTICULAR PURPOSE, OR LOSS OF USE. NO WARRANTIES SHALL ARISE UNDER THIS AGREEMENT FROM COURSE OF DEALING OR USAGE OF TRADE. Disclaimer / Limitation of Liabilities. Dispute Resolutions. This Limited Warranty is subject to the laws of the State of California, without giving effect to any conflict of laws principles and the Convention on Contracts for the International Sale of Goods. Any disputes related to this Limited Warranty will be settled through a cost-effective, binding, non-appearance-based arbitration. The arbitration will initiate through a mutually agreed upon alternative dispute resolution provider. The following rules will apply in dispute resolution: a) arbitration can be conducted via phone, online, or based solely on written submissions, at the discretion of the party initiating the arbitration; b) the process will not require personal 4 appearance of the parties or witnesses unless agreed upon by both parties; and c) the arbitrator's decision can be enforced in any court with proper jurisdiction. If arbitration is not applicable, customer hereby consents to the jurisdiction of state or federal courts in the Los Angeles County, State of California for all disputes, which will have exclusive jurisdiction. Notwithstanding anything to the contrary, Sunco reserves the right to seek injunctive or equitable relief for intellectual property rights in any competent jurisdiction. Miscellaneous. This Limited Warranty is not assignable or transferable. It covers only the original purchaser. Some states or jurisdictions do not allow the exclusion or limitation of incidental or consequential damages or exclusions or limitations on the duration of implied warranties or conditions, so the limitations or exclusions set forth herein may not apply to you. This Limited Warranty gives you specific legal rights, and you may also have other rights that vary by state or jurisdiction. No Sunco reseller, agent, or employee is authorized to make any modification, extension, or addition to this Limited Warranty. If any term is held to be illegal or unenforceable, the legality or enforceability of the remaining terms shall not be affected or impaired.
