Sizing a little off

For the most part the swim trunks fit okay but they don't quit fit right, my husband always has a problem with pants/shorts not fitting right, even though they say big or tall sizes. I'm not sure how to phrase this, he says they short waisted, they don't fit right in the seat, especially bending over... you would think that a big and tall store would know this... the waist fits but not the 'seat', sits lower than the waist...

Not Shorts, rather a bathing suit.

Its probably my fault but I didnt realize these are a bathing suit. The fabric is not soft and there is s swimwear liner inside. I still wear them as shorts and am glad I have them but they aren't as comfortable as real short and aren't exactly forgiving in the waist.
