This Classifieds Privacy Policy applies to your use of the classified listings and other resources located at the domain walmart.oodle.com and its subdomains ("Classifieds"), which is hosted by Oodle, Inc. ("Oodle"). This Classifieds Privacy Policy is different than the privacy policy ("Walmart.com Privacy Policy") available on the homepage of www.walmart.com (the "Walmart.com Site"). The Walmart.com Privacy Policy is applicable to all of the Walmart.com Site, including Classifieds. By accessing or using Classifieds you agree to comply with and be bound by both this Classifieds Privacy Policy and the Walmart.com Privacy Policy. If any terms set forth in the Classifieds Privacy Policy conflicts with the terms set forth in the Walmart.com Privacy Policy, the terms in the Walmart.com Privacy Policy shall govern.

As the host of Classifieds, Oodle will have access to all of the information Walmart.com collects from you in connection with Classifieds, including without limitation, your Personal Information (as defined below). Oodle is required to comply with the terms of this Classifieds Privacy Policy in the same manner as Walmart.com.

This Classifieds Privacy Policy may be updated from time to time. You can always review the most current version by clicking on the link to "Classifieds Privacy Policy" located at the bottom of pages on Classifieds. By using Classifieds, you consent to the terms and conditions of this Classifieds Privacy Policy and are aware that our policies may change in the future. Some listings that you access through Classifieds may be located on third party websites. If you click on these listings, you will be taken to the third party website hosting such listing and also subject to such third party's privacy policy and terms of use, if any.

In various places on Classifieds, we may collect "Personal Information," such as your name, postal address, telephone number, e-mail address, or other information that can be used to identify you or contact you. Oodle, as the host of Classifieds, will have access to this Personal Information. Walmart.com will not share any of your Personal Information with our advertisers or any third-parties for marketing purposes, except for the information you choose to publicly disclose in the listings you publish. Classifieds offers email anonymization and relay to protect your identity and reduce spam.

If you do share your email address and related password or other Personal Information with others, remember that you are responsible for all actions taken in the name of your account. If you lose control of your password for your email account, you may lose substantial control over your Personal Information and may be subject to legally binding actions taken on your behalf. Therefore, if your password for your email account has been compromised for any reason, you should immediately change your password.

Walmart.com, or people that place listings on Classifieds, may provide links to third party web sites, which may have different privacy practices than Classifieds. We are not responsible for, nor do we have any control over, the privacy policies on these third party web sites. We encourage you to read the privacy policies of every web site you visit.

To protect children's Personal Information and to meet the standards of the Children's Online Privacy Protection Act (COPPA), we do not knowingly collect any Personal Information from children under 13 that can be used to specifically identify them and Walmart.com does not permit persons under the age of 13 to use Classifieds for anything other than browsing. Classifieds is a general audience service not geared toward children. In several areas of Classifieds, including without limitation, when users place a listing on Classifieds or sign up for email newsletters and alerts, we ask for birth year information. This information helps us ensure that children do not provide us with their Personal Information. We do not save birth year information, or use it for any marketing, promotional or any other purpose. We appreciate your cooperation in helping enforce children's online privacy.

When users are involved in a transaction, they may obtain access to each other's name, email address, phone number and other contact and shipping information. We cannot guarantee the privacy or security of your information when you deal with third parties. Except as otherwise expressly included in this Classifieds Privacy Policy, this document addresses only the use and disclosure of information Walmart.com collects from you. If you disclose your information to others on Classifieds or other sites on the Internet, different rules may apply to their use or disclosure of the information you disclose to them. Walmart.com does not control the privacy policies of third parties, and you may be subject to the privacy policies of those third parties where applicable. We encourage you to ask questions before you disclose your Personal Information to others.

You can browse Classifieds without providing any Personal Information. Your Personal Information is required to place a listing on Classifieds or to use other types of functionality that require Classifieds to recognize a user (e.g., Alerts). If you decide to post a listing or sign up for certain services on Classifieds, you will need to give us certain Personal Information, such as a valid e-mail address. Except as set forth in this Classifieds Privacy Policy, this Personal Information will not be disclosed to any third-party without your explicit consent. You do not need to register with Oodle to browse, post a listing on or use Classifieds in any way. However, if you choose to or inadvertently register with Oodle for any reason, you will also be subject to Oodle's privacy policy which can be accessed at www.oodle.com.

If you wish to change the email address you provided to Classifieds in connection with the posting of a listing you must delete the old listing and place a new listing on Classifieds using your new email address. If you wish to change Personal Information you provided in your listing, you must click on the link in the email you received from Classifieds confirming your listing and follow the instructions provided to edit information in a listing. If you cannot locate your confirmation email, you must contact customer support to obtain access to your listing. If you wish to change the email address you provided in connection with a request for an email alert, you must click on the link in the email alert that permits you to remove yourself from the mailing list for such alert and then sign up on Classifieds for the alert under your new email address. You must promptly update your Personal Information if it changes or is inaccurate. We may retain Personal Information provided in connection with deleted listings or cancelled email alerts to comply with law, prevent fraud, collect any fees owed, resolve disputes, troubleshoot problems, assist with any investigations, enforce our Terms of Use, and take other actions otherwise permitted by law.

When you visit Classifieds, you will be assigned a permanent "cookie" (a small text file) to be stored on your computer's hard drive. The purpose of this cookie is to identify you when you visit Classifieds so that we can enhance our service.

You can choose to browse on Classifieds without cookies. However, without these identifier files you will not be able to take advantage of certain features of Classifieds. Each browser is different, so check your browser's "Help" menu to learn how to change your cookie preferences.

We also collect certain technical information from your computer each time you request a page during a visit to Classifieds. See "Data We Collect" for more information.

We also contract with third parties to provide us with: data collection and reporting services regarding our customers' activities on Classifieds; tracking and measuring performance of our marketing efforts and your response to our marketing efforts; and the delivery of relevant marketing messages. These third parties may use cookies and Web beacons (1 x 1 pixels), and may receive anonymous information about your browsing on Classifieds. None of your Personal Information will be received by or shared with these third parties. If you do not want your non-personal information used to serve ads to you, you can change the settings of your browser to reject cookies. Each browser is different, so check your browser's "Help" menu to learn how to change your cookie preferences.

You can browse Classifieds without telling us who you are or revealing any Personal Information. Once you give us your Personal Information, you are not anonymous to us. If you choose to provide us your Personal Information, you consent to the transfer and storage of that information on Oodle's or our servers located in the United States.

In addition to Personal Information you provide to us when posting a listing or by otherwise using Classifieds in certain ways, we collect the following information:

• When you place a listing on Classifieds, we collect a variety of information through that listing (e.g., price, model). The public will see any information that you include in your listing, and as such, Walmart.com has no control over how this information will be used. For that reason, please think carefully about what Personal Information you disclose in your listing. You may edit your listings by following the instructions in the confirmation email you received when you placed such listing on Classifieds.
• We may collect technical and usage information such as your IP address, the type of browser you use, your computer's operating system, the address of a referring website, if any, the pages on Classifieds that you visit, the search terms that you enter and the advertisements that you click. This information does not personally identify you and is used to help us diagnose problems, administer Classifieds and otherwise improve our service to you and for marketing purposes.
• Depending on the service used on Classifieds, Walmart.com or Oodle may collect financial information such as credit card or bank account information. Credit card information is collected but not stored. It is transmitted to a financial gateway using Secure Socket Layer (SSL) technology.
• We sometimes collect your email address, for purposes such as posting a listing, sending email alerts and confirmation emails and providing you support when you click on the "Contact Us" link on Classifieds.
• We may collect Personal Information if you provide it in feedback, comments or surveys, post it on our Classifieds, or if you contact us directly. Please do not post any Personal Information on Classifieds that you expect to keep private.

Our primary purpose in collecting Personal Information is to provide you with a safe, smooth, efficient, and customized experience. We do not sell or rent Personal Information to any third parties. You agree that we may use your Personal Information to:

• provide the services and customer support you request;
• respond to your questions or suggestions;
• resolve disputes, collect fees, and troubleshoot problems;
• prevent potentially prohibited or illegal activities, and enforce our Terms of Use;
• customize, measure and improve our services, content and advertising;
• tell you about offers, service updates, and promotional offers based on your communication preferences;
• comply with valid legal procedures, requirements, regulations or statutes;
• inform you of changes to Classifieds that might affect your Personal Information; and
• compare information for accuracy, and verify it with third parties.

We may share aggregated demographic, statistical and usage information with our partners or advertisers. This is not linked to any Personal Information that can identify any individual person.

The following information may be stored in our database, even after deletion, and may be archived and stored indefinitely:

• Email addresses and other information you provide to Classifieds
• All listing and review content
• Activity logs and other records

Walmart.com may disclose information about Classifieds users if required to do so by law or in the good faith belief that such disclosure is reasonably necessary to:

• Respond to a legal process (e.g., subpoenas, court orders)
• Respond to claims that a listing or content violates the rights of third parties
• Enforce our Terms of Use
• Protect the rights, property or personal safety of Walmart.com, its users or the general public

We may also share your Personal Information with:

• Our affiliates to help detect and prevent potentially illegal acts and provide relevant information. Our corporate affiliates will send marketing communications only to users who request these services.
• Service providers under contract who help with our business operations.
• Other third parties to whom you explicitly ask us to send your information (or about whom you are otherwise explicitly notified and consent to when using a specific service).
• Law enforcement or other governmental officials, in response to a verified request relating to a criminal investigation or alleged illegal or unlawful activity. In such events, we will disclose information relevant to the investigation, such as name, city, state, zip code, telephone number, email address, IP address, fraud complaints, and listing history.
• Other business entities, should Walmart.com or Oodle plan to merge with or be acquired by that business entity. Should such a combination occur, we will require that the new combined entity follow this Classifieds Privacy Policy with respect to your Personal Information. If your Personal Information will be used contrary to this Classifieds Privacy Policy, you will receive notice on Classifieds.

The security of your Personal Information is very important to us. In our efforts to protect your online transactions, we use a technology called Secure Sockets Layer (SSL). If your browser is capable of SSL (and most are), your Personal Information will be automatically encrypted, or encoded, before it is sent over the Internet.

Although Walmart.com uses these methods to protect your Personal Information, third parties may unlawfully intercept or access transmissions or private communications, and other users may abuse or misuse your Personal Information that they collect from Classifieds. Therefore, although we work hard to protect your privacy, we do not promise, and you should not expect, that your Personal Information or private communications will always remain private, and you acknowledge and agree that we will have no liability to you or to any third party arising out of any such loss, misuse or alteration.

You acknowledge that search engines and other sites not affiliated with Walmart.com — including without limitation, archive.org, google.com, and groups.yahoo.com — may archive or otherwise make available Classifieds listings. If you remove or modify your listings on Classifieds, there is a possibility one of these sites may provide access to old or deleted listings. Walmart.com is not responsible in any way for any display of such listings by these third party sites.

We and our users do not tolerate spam. You are not licensed to add other Classifieds users, even a user who has purchased an item from you, to your mailing list (email or physical mail) without their express consent. If you believe you have received a Classifieds-related spam or spoof email please review Online Security: Phishing and follow the instructions to report such activities to Walmart.com. You may not use our communication tools to send spam or otherwise send content that would violate our Terms of Use.

This Classifieds Privacy Policy was last amended on May 15, 2008. We may amend this Classifieds Privacy Policy at any time by posting the amended terms on Classifieds without any other notice to you. Any such amendment will be effective immediately upon posting to Classifieds. It is your responsibility to review this Classifieds Privacy Policy each time you use Classifieds to ensure you understand the terms applicable to you as a result of such use.
